TERMS AND CONDITIONS OF USE
Pacific Disaster Center (“PDC”) applications, data, information services, and content (referenced separately or collectively referred to as “Applications, Tools, Products, and Services”) are provided for free to the public and the “Users” for enhanced situational awareness. By accessing and/or using these Applications, Tools, Products, and Services, “Users” (or “You”) acknowledge that you understand, and agree to follow the Terms and Conditions of Use stated in this document.

You also understand that PDC’s Products, and Services gather and integrate information from various providers and data sources, and that some of the information may be restricted for use by emergency management professionals. You understand and agree:

a) To comply with all Terms and Conditions associated with the original data sources, including all licensing agreements, distribution restrictions, and other conditions. The original sources of data are found in the “metadata” records and descriptions.

b) To use the information solely for disaster/emergency management and/or safety purposes, and that you will not distribute such information (outside of your “immediate danger zone and interest”) without explicit written authorization from PDC. Immediate danger zone and interest is defined as fear of impending hazard impacting acquaintances (such as family, friends, neighbors, co-workers, etc.) or their properties. If a hazard is not impending, distribution of Products and Services is allowed ONLY for emergency management purposes and with proper attribution to PDC and other information providers, as may be required by the licensing agreements.

c) Not to use Applications, Tools, Products, and Services (or related information and applications) for commercial purposes. As such, you agree not to sell, resell, or otherwise distribute the information to others for commercial business use.

d) Not to use Applications, Tools, Products, and Services, directly or indirectly, in an unlawful matter and/or in support of any unlawful activity.

e) That if an account is required to access Applications, Tools, Products, and Services, you will not to share your account information (if any) with others. By creating an account for you at your request, PDC only authorizes access for you, and you will be held accountable for any misuse of your account by you or others.

f) That if an account is required to access Applications, Tools, Products, and Services, you will use the account lawfully and for the sole intended purposes. You understand and agree that the account may not be used to exploit or probe (electronically or otherwise) other PDC services and/or those of the PDC partners and users.

g) That PDC reserves the rights to terminate any account at its sole discretion, with or without notice.

DISCLAIMER OF LIABILITIES FOR PRODUCTS AND SERVICES AND OF THEIR USAGE
a) PDC is providing Applications, Tools, Products, and Services on an “as is” basis. Best effort is made to ensure accuracy, timeliness, and availability of the Products and Services.  Best effort is also made to ensure that Applications, Tools, Products, and Services are free of defects.  By using the Applications, Tools, Products, and Services, You understand and agree that these services, related information, and applications may not be available due to network interruptions, provider outages, maintenance, or some/any other issue(s). You further understand and agree that PDC cannot be held responsible for any disruption of services or interruption in delivery of the Applications, Tools, Products, and Services (or related information and applications).

b) PDC makes use of and integrates information from reputable sources and models. You understand and agree that PDC makes no representations and provides no warranties regarding the accuracy, completeness, timeliness, currentness, fitness for a particular purpose, or non-infringement of the information.

c) Some of PDC Applications, Tools, Products, and Services make use of various modeling capabilities to estimate anticipated hazard impacts. You understand that these estimates are made based on the available data and conditions, and that they may not necessarily reflect the actual impact. You further understand and agree that PDC cannot be held responsible for the accuracy of these estimates.

d) PDC presents its Applications, Tools, Products, and Services for enhanced situational awareness. However, PDC cannot be held responsible for any decision Users (or You) make based on the provided information or any of the Products and Services. You understand and agree that PDC cannot and does not assume any liability for any damages or expenses associated with your (direct or indirect) decisions and actions based on PDC-provided information or application services.

e) PDC may change or discontinue any Applications, Tools, Products, and Services at its sole discretion, and with or without notice. By using Applications, Tools, Products, and Services, you understand and agree that PDC does not assume any liability for any damages or expenses associated with such changes and or discontinuations.

Pacific Disaster Center (PDC) does not assume any legal liability or responsibility for the accuracy, completeness, or usefulness of any information, apparatus, product, or process disclosed in this website, nor does PDC represent that the use of such information, apparatuses, products, or processes would not infringe on privately owned rights. Reference within pdc.org to any specific commercial product, process, or service by trade name, trademark, manufacturer, or otherwise does not necessarily constitute or imply its endorsement or recommendation. No warranty, expressed or implied, is made by PDC as to the accuracy of the data included in any related materials or the functioning of the software.
